Terms & Conditions

Clear expectations protect both the client and the photographer.

These are the general terms applying to the Musar Studio website and to photography services supplied through Musar Studio.

Individual assignments may also have a quotation, booking confirmation and image licence containing terms specific to that job.

The Assignment Documents Matter

These Terms provide a general framework. Before a client becomes contractually bound, the relevant quotation or booking documentation should identify the contracting trader and provide the legal contracting name, geographic business address and appropriate contact information, together with the information required for that particular booking.

A quotation or booking confirmation may also contain specific terms dealing with price, deposit, expenses, cancellation, delivery and image usage.

01 Identity

Who You Are Contracting With

Musar Studio is the name used for this website and photography business.

The legal person or entity supplying an assignment, together with the relevant geographic business address and contact information, will be identified in the quotation or booking documentation before the client is bound by the contract.

02 Booking

Enquiries, Quotes & Contract Formation

An enquiry does not by itself reserve a date or create a photography contract.

Before confirmation, the relevant documents should make clear, where applicable:

  • the photography service being supplied;
  • date, location and expected coverage;
  • the total price, or how the price will be calculated;
  • whether applicable taxes are included;
  • known travel or other additional costs;
  • deposit and payment arrangements;
  • cancellation or rescheduling conditions;
  • expected delivery arrangements; and
  • the agreed licence for use of the photographs.

A booking becomes binding only in the way stated in the relevant quotation or booking confirmation, for example upon written acceptance and any required payment.

03 Service

Professional Standard

Musar Studio will provide agreed photography services with reasonable care and skill.

Photography necessarily involves professional judgement, including decisions about timing, framing, lighting, selection and editing.

The agreed brief will guide the work, but no particular unrepeatable moment can be guaranteed unless that result has been expressly agreed and is realistically within our control.

04 Payment

Fees, Deposits & Expenses

The quotation or booking confirmation will state the price and any deposit, advance payment, expenses or payment schedule that applies.

A deposit will not automatically be treated as non-refundable simply because it is called a deposit.

Where a consumer cancels and a cancellation charge applies, it should be fair and proportionate to losses reasonably resulting from that cancellation, taking account of costs saved and reasonable steps available to reduce those losses.

Significant additional work requested outside the agreed scope may require a revised quotation.

Consumer Distance Bookings

Cancellation Rights Where the Law Provides Them

If you are a consumer and enter into an eligible distance or off-premises service contract, you will normally have a statutory 14-day cancellation period beginning when the service contract is made, subject to applicable exceptions.

Where that right applies, the booking information will explain how to exercise it.

Starting Work During the 14-Day Period

If you ask Musar Studio to begin providing services before the cancellation period has expired, we may ask you to make an express request for early performance.

If you then exercise a valid cancellation right after work has started, you may be required to pay a proportionate amount for services supplied up to the time you cancel, where the law permits this.

Where the law provides that a cancellation right is lost after a service has been fully performed, this will only be relied upon when the statutory requirements for that loss of the right have been satisfied.

Nothing here removes a statutory right that cannot lawfully be excluded.

If a Statutory Cancellation Right Applies

You may communicate a clear cancellation statement using the contact details supplied with your booking. You may also use the following wording:

05 Client Cancellation

Cancellation & Rescheduling by the Client

Any assignment-specific cancellation or rescheduling conditions will be made clear before the booking is confirmed.

Where a charge is permitted, it should not operate as a disproportionate penalty. Relevant circumstances may include work already undertaken, committed costs and losses directly caused by the cancellation, together with reasonable steps taken to reduce those losses.

Consumer statutory cancellation rights, where applicable, take priority over inconsistent contractual wording.

06 Studio Cancellation

If Musar Studio Cannot Perform the Assignment

Serious illness, accident, unsafe conditions, substantial equipment failure, transport disruption or another circumstance genuinely beyond reasonable control may occasionally make the agreed assignment impossible.

Where reasonably possible, we will first discuss rescheduling the assignment.

A substitute photographer will not be imposed on the client. Any alternative photographer or alternative arrangement would require the client's agreement.

If Musar Studio cancels and the client is not at fault, and the service cannot reasonably be rearranged, amounts paid for services that will not be supplied will be refunded as required by the contract and applicable law.

07 Conditions

Weather, Safety, Access & Events

Outdoor, travel and marine photography can depend on weather, sea state, safe access and other conditions outside the photographer's control.

Musar Studio will not knowingly place people, crew or equipment at unreasonable risk merely to obtain an image.

Coverage can also be affected by accreditation, venue restrictions, unavailable subjects, programme changes or circumstances at an event.

08 Delivery

Selection, Editing & Delivery

Delivery format, expected scope and any important deadline should be confirmed for the individual assignment.

Professional selection and editing form part of the photographic process.

RAW or otherwise unfinished files are not included unless specifically agreed in writing.

Clients should download and securely retain delivered files they need to keep.

Photography Rights

Copyright and the Licence to Use Images Are Different Things

Unless otherwise agreed in writing, copyright in photographs created by Musar Studio remains with the photographer or other relevant copyright owner.

Copyright

Paying for commissioned photography does not by itself transfer copyright ownership.

Licence

The agreed licence may define purpose, media, territory, duration, exclusivity or other permitted uses.

Additional Use

A materially different use outside an agreed licence may require further permission or an additional licence.

09 Portfolio

Portfolio, Publicity & Client Privacy

Ownership of copyright does not mean that every commissioned photograph will automatically be published by Musar Studio.

Portfolio or promotional use may depend on:

  • the nature of the commission;
  • privacy and confidentiality;
  • embargoes or non-disclosure obligations;
  • the rights of people depicted;
  • whether the work was commissioned for private or domestic purposes; and
  • any specific agreement with the client.

Where permission is required for Musar Studio to publish commissioned photographs, that permission will not be assumed merely because Musar Studio owns the copyright.

10 Permissions

People, Venues & Releases

Responsibility for model releases, property permissions, accreditation or other permissions needed for a particular use should be agreed before the assignment where relevant.

The existence of a model or property release must not be assumed unless it has actually been obtained.

The client must provide accurate information about intended commercial or advertising use where that use may affect permissions required.

Editorial & Informational Content

Project Musar Is a Documentary Record, Not Professional Marine Advice

Project Musar may describe sailing, navigation, maintenance, repairs, equipment, preparation and decisions made in relation to Musar.

This material documents personal experience, research and an evolving sailing project.

It is provided for editorial and informational purposes and should not be treated as professional marine-engineering, surveying, electrical, mechanical, navigational, meteorological or safety advice.

Boats, equipment, crews and conditions differ. Readers should verify critical information against appropriate manufacturer documentation, official navigational and safety information, and suitably qualified professionals where required.

11 Archive

File Storage & Archiving

Unless a specific archive commitment is agreed in writing, Musar Studio does not promise to retain client files indefinitely.

The client should maintain appropriate backups of delivered photographs.

12 Website

Website Content & Intellectual Property

Photographs, text, graphics and other original material on this website may be protected by copyright and other intellectual-property rights.

Public availability on the website does not, by itself, grant permission for commercial copying, republication or reuse.

13 Liability

Liability & Mandatory Rights

Nothing in these Terms excludes or limits liability, or a consumer right, where applicable law does not allow that liability or right to be excluded.

These Terms should not be interpreted as excluding responsibility for failing to provide agreed services with the standard required by applicable consumer law.

14 Complaints

Problems & Complaints

If you believe an assignment has not been supplied as agreed, please contact Musar Studio promptly and explain the issue.

We will consider the complaint and try to resolve genuine problems reasonably.

Nothing in this process removes any statutory route or remedy available to a consumer.

15 Law

Law, Jurisdiction & Changes

Musar Studio operates from England. These general Terms are intended to be governed by the laws of England and Wales, subject to mandatory rights that may apply to a consumer and cannot lawfully be displaced.

These website Terms may be updated when services, business practices or legal requirements change.

Updating this website page does not retrospectively rewrite a separately agreed photography contract.

Before Confirming an Assignment

Make Sure the Practical Details Are Clear

Price, timing, expenses, cancellation, delivery and image usage should be understood before the booking is confirmed.

If something is unclear, ask before accepting the quotation.
